Personal Information Collection Statement (the “Notice”)

The Personal Data (Privacy) Ordinance (the “Ordinance”) governs the collection, holding, processing and use of your personal data and other information that the Group, namely OnePlatform International Limited and its subsidiaries and affiliates, (“we”, “us”, “ours”) may collect from the applicant (“you”, “your”) from time to time (the “Data”). For the purpose of this Notice, “affiliates” shall mean, with respect to a company, any of that company’s holding companies, subsidiaries, or entities under common control as that company, or entities managed or advised by that company, that company’s holding company or subsidiaries or any of their financing providers. If you do not provide your Data to us, we may be unable to process the application for the product(s) and/or service(s) you are applying for.

Any “member of the Group” means the Group’s affiliates, subsidiaries, associated entities and any of their branches and offices.　

Purpose

You agree that your Data may be used for the following purposes:

1. where applicable, processing the application for the securities services or for the product(s) and/or service(s);
2. verifying or assessing any information and records relating to you;
3. communication between you and us;
4. provision of the services in connection with your account/claims;
5. management, operation and maintenance of your account;
6. exercising our rights under the contractual agreement(s) with you, including collecting amounts outstanding from you;
7. marketing or designing products or services provided by us or any member of the Group;
8. meeting any obligations, requirements or arrangements, which we or any member of the Group should comply with, as required by laws, rules, regulations, codes or guidelines; and
9. other purposes related or incidental to any of the above.

Transfer

Data will be kept confidential by us, but we may transfer or disclose your Data to the following parties whether within or outside Hong Kong:

• any agents, contractors, subcontractors, or service providers (including but not limited to other brokers, whether in Hong Kong or other jurisdictions) who provide services to us or any member of the Group in connection with the operation or maintenance or marketing of our business;
• any person under a duty of confidentiality to us or any member of the Group which has undertaken to keep such information confidential;
• any party enters into or proposes to enter into the transaction for and on your behalf; 
• credit reference agencies or, in the event of default, debt collection agencies; 
• any actual or proposed assignee of ours or participant or sub-participant, transferee, delegate, successor or party as stated in the Privacy Policy Statement of our rights in respect of you;
• where applicable, any exchanges, clearing houses, any local or foreign legal, regulatory, governmental, tax, law enforcement agencies or regulatory bodies or other authorities, or self-regulatory or industry bodies or associations of financials services providers for compliance with the obligations, requirements or arrangements according to any present or future contractual or other commitment that is assumed by or imposed on us or any member of the Group by reason of its financial, commercial, business or other interests or activities in or related to the jurisdiction of the relevant exchanges, clearing houses, local or foreign legal, regulatory, governmental, tax, law enforcement or other authority, or self-regulatory or industry bodies or associations; with respect to data in connection with mortgages applied by you (if applicable, and whether as a borrower, mortgagor or guarantor and whether in your sole name or in joint names with others) on or after 1 April 2011, the following data relating to you (including any updated data of any of the following data from time to time) may be provided by us, on its own behalf and/or as agent, to a credit reference agency:

1. full name;
2. capacity in respect of each mortgage (as borrower, mortgagor or guarantor, and whether in your sole name or in joint names with others);
3. identity card number or travel document number;
4. date of birth;
5. correspondence address;
6. mortgage account number in respect of each mortgage;
7. type of the facility in respect of each mortgage;
8. mortgage account status in respect of each mortgage (e.g. active, closed, write-off; and
9. if any, mortgage account closed date in respect of each mortgage.

The credit reference agency will use the above data supplied by us for the purposes of compiling a count of the number of mortgages from time to time held by you with credit providers in Hong Kong, as borrower, mortgagor or guarantor respectively and whether in the your sole name or in joint names with others, for sharing in the consumer credit database of the credit reference agency by credit providers (subject to the requirements of the Code of Practice on Consumer Credit Data approved and issued under the Ordinance).

• any authorities, any law enforcement agencies or regulatory bodies for compliance with applicable laws, rules, regulations, codes and guidelines or any person or entity to whom we or any member of the Group are under a binding obligation to satisfy a legally enforceable demand for disclosure under the requirements of any law, rule, regulation, code, guideline.

Use of Cookies

When you browse our websites, cookies will be stored in your computer or electronic device’s browser. The purposes of using cookies in the sites are to remember the different font size you have chosen in the sites and also to facilitate the security checking (the test that asks you to enter the validation code displayed on screen) in all the online forms. Most browsers are by default set to accept cookies. You have a choice not to accept the cookies by disabling such settings. However, by disabling them, you may not be able to utilise the full functions of our websites, including online services. The websites do not use cookies to collect your personal data.

Direct Marketing

We intend to use your Data (i.e. your name, address, email address, fax and telephone number) you provided in the Account Opening Form/Application Form/Client Agreement for direct marketing, but we will not use the Data unless we have received your consent.

• check whether we hold your Data and to have access to that Data;
• require us to correct any of your Data which is inaccurate; and
• ascertain our policies and practices in relation to your Data. 

We reserve the right to charge you a reasonable fee for complying with any request for access to your Data.
